Service Terms and Conditions (Full Version)
 
1. Services & Payment
All services and fees are described in your personalized booking proposal or invoice.
A 30% non-refundable retainer is required to secure your date. The remaining balance is due as outlined in your payment schedule (typically 30% the week of your wedding and 40% upon delivery).
Payments can be made by e-transfer or cash and are subject to 13% HST.
No services will be rendered without payment in accordance with the agreed schedule.

2. Rescheduling & Cancellations

• Rescheduling: You may reschedule at no extra cost if the new date is available.

• Cancellation: If you cancel, your retainer is forfeited as liquidated damages.

• If the Photographer must cancel due to illness, injury, or emergency, every effort will be made to find a replacement. If none is available, a full refund will be issued.
   

3. Deliverables
After the event, edited photographs will be delivered through an online gallery (Pixieset) within the agreed timeline.
Packages may include digital images, optional albums, or Polaroids as described in your booking.
RAW or unedited files are not provided under any circumstances.

4. Copyright & Usage
All photographs remain the copyrighted property of Your Big Day Photography.
You receive a non-exclusive, personal-use license to print and share your images for personal enjoyment.
The Photographer retains the right to use selected images for portfolio, website, or social media promotion.
You may opt out of promotional use by providing written notice before the wedding date.

5. Creative Style & Editing
You acknowledge that photography is an artistic service.
By booking, you confirm you are familiar with the Photographer’s portfolio and editing style.
Color tone, lighting, and editing approach may vary from previous work. Artistic discretion rests solely with the Photographer.

6. Client Cooperation
You agree to assist in achieving the best results by:

• Providing a list of must-have photos before the event.

• Ensuring reasonable access to the venue and participants.

• Assigning a family member or coordinator to help organize group shots.

The Photographer is not responsible for missed images due to interference, weather, or time constraints.

7. Limit of Liability
The Photographer will take all reasonable precautions to safeguard images.
In the unlikely event that images are lost, stolen, or destroyed beyond the Photographer’s control, liability is limited to the return of payments received for undelivered services.
The Photographer is not liable for incidental or consequential damages.

8. Ownership & Approvals
The Photographer retains ownership of all image files.
You are granted a personal-use license only.
Proofs, album designs, or video drafts must be reviewed within 10 days of delivery. After that period, they are considered approved.

9. Indemnification
You agree to indemnify and hold harmless Your Big Day Photography and its team from any claims or damages resulting from:

• Unsafe working conditions,

• Interference by guests or third parties, or

• Misuse or alteration of delivered images.
   

10. Confidentiality
Both parties agree to treat personal and event-related information as confidential and not disclose it to third parties, except as required by law or necessary to fulfill the contract (e.g., album printing, editing).

11. Force Majeure
Neither party is responsible for delays or non-performance caused by events beyond reasonable control, including natural disasters, illness, or equipment failure.
If such an event occurs, reasonable efforts will be made to reschedule or provide a partial refund for undelivered services.

12. Independent Contractor
Your Big Day Photography operates as an independent contractor.
No employment, joint venture, or partnership relationship exists between the Photographer and Client.

13. Governing Law
This Agreement is governed by the laws of the Province of Ontario, Canada.
Any disputes will be handled in the courts of Peel Region, Ontario.

14. Entire Agreement & Modifications
These Terms, together with your signed proposal or invoice, constitute the entire agreement between the parties.
Any modification must be made in writing and signed by both parties.
